1. Introduction

These Terms and Conditions govern all orders and services provided by Once Upon a Tier Ltd (“we”, “us”, or “our”). By placing an order, you (“the Client”) agree to be bound by these terms. Please read them carefully before confirming your order.

2. Orders and Bookings

  1. All cake orders must be placed in writing via our website, email, or consultation.
  2. A non-refundable deposit is required to secure your booking. The deposit amount will be specified in the order confirmation.
  3. Full payment must be received prior to collection or delivery of the cake, unless otherwise agreed in writing.
  4. Orders are only confirmed once the deposit is received and the design, flavour, and specifications are agreed.

3. Changes and Cancellations

  1. Any changes to the design, flavour, or specifications must be requested in writing. We will make reasonable efforts to accommodate changes but cannot guarantee them after certain production stages.
  2. If the Client cancels an order:
    • Deposits are non-refundable.
    • Cancellation after production has commenced may result in additional charges to cover costs incurred.
  3. Once Upon a Tier Ltd reserves the right to cancel an order if the Client fails to meet payment obligations or provides false or misleading information.

4. Delivery and Collection

  1. Delivery times and dates are agreed upon at the time of order. While we aim to meet all deadlines, we cannot be held liable for delays caused by circumstances beyond our control.
  2. Cakes must be collected or received in the condition agreed. We are not responsible for damage caused after delivery or during client handling.
  3. Any delivery charges will be specified in the order confirmation.

5. Allergens and Dietary Requirements

  1. Clients must inform us of any dietary requirements or allergies at the time of order.
  2. We take reasonable steps to accommodate special dietary needs but cannot guarantee the complete absence of allergens due to shared kitchen facilities.
  3. Once Upon a Tier Ltd is not liable for any allergic reactions if the Client fails to disclose relevant information.

6. Custom Designs and Intellectual Property

  1. All designs, sketches, recipes, and photographic images remain the intellectual property of Once Upon a Tier Ltd unless otherwise agreed in writing.
  2. Clients may not reproduce or use our designs commercially without prior consent.

7. Quality and Liability

  1. We use high-quality ingredients and professional techniques to ensure the highest standards.
  2. In the unlikely event of a fault with the cake, liability is limited to a replacement cake of equivalent value or a refund of the amount paid.
  3. Once Upon a Tier Ltd is not liable for indirect losses, including loss of profit or disappointment.

8. Photography and Marketing

  1. We may photograph cakes for promotional purposes. By confirming an order, the Client consents to these images being used on our website, social media, or other marketing materials.
  2. Any Client request for anonymity or non-disclosure of images must be made in writing prior to delivery.

9. Privacy

  1. Any personal data collected is used solely for fulfilling orders and communications.
  2. We comply with UK data protection laws. Our full Privacy Policy provides further details on how your information is stored and used.

10. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from orders with Once Upon a Tier Ltd shall be subject to the exclusive jurisdiction of the courts of England and Wales.
